Auto body shop

There are several state and federal regulations affecting auto body shops in Wisconsin. Among these is the EPA’s area source rule for paint stripping and miscellaneous surface coating operations. To help newly regulated shops comply, the Small Business Environmental Assistance Program (SBEAP) partnered with other states in the region to develop a comprehensive self-certification checklist and other tools to help the industry understand these and other regulations.

Compliance assistance

This section includes resources on air pollution, waste and water regulations that may apply to shops.

Air regulations

For additional information on the area source rule for paint stripping and miscellaneous surface coating operations in Wisconsin, Illinois, Indiana, Michigan, Minnesota and Ohio, including a self-certification checklist, visit the Environmental Results Program (ERP) tab above. This tab also contains information on waste and water issues relevant to auto body shops.

Waste regulations

On the Environmental Results Program tab above, click on the Wisconsin specific page link. It includes a good list of waste fact sheets to address issues such as waste paint, booth filters, used oil, oil filters, antifreeze, etc. In addition, these resources may be helpful:

Environmental results program

The DNR and the Small Business Environmental Assistance Program (SBEAP) collaborated with the Small Business Environmental Assistance programs in Illinois, Indiana, Michigan, Minnesota, Ohio and Wisconsin to develop an Environmental Results Program (ERP) for the auto body refinishing shops in these U.S. Environmental Protection Agency (EPA) Region 5 states.

WDNR was awarded a State Innovation Grant by EPA to conduct the Auto Body ERP in partnership with the other Region 5 states. The ERP project involved measuring environmental performance at shops to learn the areas where additional assistance was needed for the shops to understand how to comply with state and federal rules. A particular focus was on a new (in 2008) rule from the EPA affecting auto body shops nationwide. Based on what the states learned in the baseline visits, compliance assistance and training materials were developed to assist in the areas of greatest need. Following SBEAP efforts to provide compliance assistance and other training to shops, EPA staff visited a sample of shops to measure their compliance rates.

The final Grant Report to EPA Region 5 summarized the results of the effort to measure environmental performance among auto body shops in Region 5 states. The study found that 18 out of 25 measures showed statistically significant improvement in performance on the EPA auto body rule. For more details, read the final grant report: Region 5 States Environmental Results Program for Autobody Refinishing Shops [PDF].

Shop compliance checklist packets and training

The state SBEAPs developed a common checklist with state specific tips on how to know whether your shop is in compliance with EPA's rule as well as state air, waste and water requirements. Completing the first part of the checklist (all "EPA - Rule" sections) will help you make sure you have met all the requirements in EPA's rule.

Materials referenced in the checklist that provide additional information about particular requirements are linked in the specific state tabs on this page. Additional materials helpful to shops in any state are provided on the General materials for all states web page, including resources for painter training.

Submitting the notification of compliance status form

For any shop that has not submitted the Notification of Compliance Status form yet, this would particularly apply to new shops, the form must now be filed electronically with EPA through their Electronic Reporting Tool (ERT). For more information on how to register for EPA's electronic reporting system and filing compliance reports, go to [Exit DNR].

Using the self-certification checklist

Printable copies of the self-certification checklist are available on the individual state web pages linked below, and they are available in both Microsoft Word and Adobe PDF versions.
