Superior Refining Company LLC, located at 2407 Stinson Avenue, Superior, Douglas County, Wisconsin, FID 816009590, submitted to the DNR a permit application, including plans and specifications for an asphalt import project at a petroleum refinery. The project includes the construction of an asphalt rail unloading station, an asphalt truck loading station, an asphalt truck loading haul road and the modification of four asphalt storage tanks. The project is being aggregated with the Rebuild Project authorized under construction permit 19-RAB-057. Air pollution control construction permit no. 20-RAB-080.

Due to state measures being implemented to prevent spread of the COVID-19 virus, this hearing will be held via Zoom, rather than in person. With high interest in this hearing, the department is asking all attendees who are choosing not to provide oral testimony during the hearing to watch it on MediaSite. Detailed information: The Remediation and Redevelopment Program is proposing revisions to chs. NR 700 to NR 754, Wis. Adm. Code, as well as the creation of chs. NR 756 and 758. The purpose of these revisions is to provide procedures for new requirements and statutory changes under 2015 Wisconsin Act 204, to provide consistency with 2017 Wisconsin Act 70, to ensure adequate direction is available in code for the investigation and remediation of contaminated sediment, and to make other targeted changes that are needed to update, clarify and promote consistency within the NR 700 rule series. The department will hold one public hearing via Skype for both rules. The Skype link is available in the Public Hearing notice.The public has the opportunity to testify at the hearing. Petitioners sought the permit for construction on their property located in the NE1/4 of the NE1/4 of Section 31, Township 20 North, Range 10 West, Town of Cross, Buffalo County. The project consisted of constructing a driveway to access a building site for a principal residence. Petitioners discharged dredged or fill material into a wetland to construct the driveway. DNR determined that the proposed project did not meet the standards required pursuant to Wis. Stat. 281.36(3n) and the wetland individual permit was denied.

On February 21, 2020, Petitioners filed a Petition for a Contested Case Hearing with the DNR to review the decision to deny after-the-fact wetland permit application, pursuant to Wis. Stat. 227.42 and 281.36(3q)(b).
