Comments: On July 6, 2018, Miller Compressing Company, also acting as agent for other riparian owners in the project area, was granted permit, under Section 30.12(3m) & Section 30.20(2), Wisconsin Statutes, to remove materials from and place a structure (Remedial Aggregate Cap and Voluntary Betterment) on the bed of the Burnham Canal. On January 17, 2019, Miller Compressing Company was also granted permit by the U.S. Army Corps of Engineers to conduct these activities. On August 31, 2018, Miller Compressing Company was granted a Low-Hazard Exemption from WDNR, permitting reuse of a portion of the sediment dredged for the above-referenced project within the Burnham Canal to level out the western portion of the canal prior to cap and betterment placement. On December 19, 2018, Miller Compressing Company received a WDNR Concurrence Letter for the Groundwater Sampling Report and No Further Action Request prepared by OBG and dated May 21, 2018. The letter states that no further action related to groundwater for the Site is necessary and that the Site's monitoring wells may be abandoned. Monitoring wells were abandoned on January 10, 2019. Well abandonment forms and investigative waste disposal documentation will be submitted to WDNR. The Negotiated Agreement, deferring the remedial action portion of the project (limited dredging and placement of Remedial Aggregate Cap) from USEPA to WDNR, was finalized on November 27, 2018. Contracts and agreements associated with remedial action and betterment construction are currently being negotiated.
