Comments: On July 6, 2018, Miller Compressing Company, also acting as agent for other riparian owners in the project area, was granted permit, under Section 30.12(3m) & Section 30.20(2), Wisconsin Statutes, to remove materials from and place a structure (Remedial Aggregate Cap and Voluntary Betterment) on the bed of the Burnham Canal. On June 15, 2018, Miller Compressing Company submitted a Low-Hazard Exemption Request to WDNR, requesting to reuse a portion of the sediment dredged for the above-referenced project within the Burnham Canal to level out the western portion of the canal prior to cap and betterment placement. On May 21, 2018, Miller Compressing Company submitted a Groundwater Sampling Report and No Further Action Request to WDNR. An additional check for this technical assistance was received by WDNR on July 3, 2018. The report requests a Technical Support Letter from WDNR stating that the groundwater is not a pathway of concern with respect to the discharges at the west end of the Burnham Canal and that the investigation at the Site meets WDNR closure criteria with respect to groundwater, and that no further groundwater investigation or remediation associated with the Site is necessary. Deferral of the remedial action portion of the project (limited dredging and placement of Remedial Aggregate Cap) from USEPA to WDNR is expected to be finalized within the next reporting period (7/1/2018 – 12/31/2018). Contracts and agreements associated with remedial action and betterment construction are currently being negotiated.
