On July 1, 2019, the DNR issued a Wisconsin Pollutant Discharge Elimination System (WPDES) Permit, No. WI-0061794-04-0, to B&D Dairy Farm, LLC. The permit was issued to regulate the discharge from a livestock operation located at (Main Farm) W7251 E. 6th Rd., Pound, Wisconsin, (Heifer Facility) W7276 E. 6th Rd., Pound, Wisconsin, (Little River Satellite WSF) 7651 Hillcrest Rd., Oconto, Wisconsin, which would discharge into Little Peshtigo River, Lower Peshtigo River, Little River, Middle Peshtigo River and Thunder River Watersheds, Lake Michigan Basin in accordance with the effluent limitations, monitoring requirements and other conditions on the management and utilization of manure and process wastewater specified in the permit.

On July 26, 2019, the B&D Dairy Farm, LLC, filed a Petition for a Contested Case Hearing with the DNR to review the decision to reissue the WPDES permit to B&D Dairy Farm, LLC, pursuant to s. 283.63, Wis. Stats.

The State of Wisconsin Division of Hearings and Appeals will hold a public hearing on the above matter via BlueJeans videoconferencing software September 28 through September 30, 2020, commencing at 9 a.m. and concluding no later than 4:30 p.m. each day.

Members of the public desiring to participate in this hearing will be allowed the opportunity to do so at the end of the presentation of evidence. These seasons are part of the federal migratory bird season frameworks and the United States Fish and Wildlife Service (USFWS) needs to be informed of the State of Wisconsin Natural Resources Board decisions on these seasons in the spring season of 2020.

Detailed information: The Remediation and Redevelopment Program is proposing revisions to chs. NR 700 to NR 754, Wis. Adm. Code, as well as the creation of chs. NR 756 and 758. The purpose of these revisions is to provide procedures for new requirements and statutory changes under 2015 Wisconsin Act 204, to provide consistency with 2017 Wisconsin Act 70, to ensure adequate direction is available in code for the investigation and remediation of contaminated sediment, and to make other targeted changes that are needed to update, clarify and promote consistency within the NR 700 rule series. Petitioners sought the permit for construction on their property located in the NE1/4 of the NE1/4 of Section 31, Township 20 North, Range 10 West, Town of Cross, Buffalo County. The project consisted of constructing a driveway to access a building site for a principal residence. Petitioners discharged dredged or fill material into a wetland to construct the driveway. DNR determined that the proposed project did not meet the standards required pursuant to Wis. Stat. 281.36(3n) and the wetland individual permit was denied.

On February 21, 2020, Petitioners filed a Petition for a Contested Case Hearing with the DNR to review the decision to deny after-the-fact wetland permit application, pursuant to Wis. Stat. 227.42 and 281.36(3q)(b).

On April 19, 2019, the DNR issued a permit to Linda Wright to install riprap on the banks of the Milwaukee River in the Village of River Hills, Milwaukee County, pursuant to Wis. Stat. 30.12(3m), specifically on her property described as being in the NW1/4 of the NE1/4 of Section 18, Township 08 North, Range 22 East.

On May 16, 2019, Frederick and Anne Vogel submitted a petition for a contested case hearing to review the decision and, on June 17, 2019, the DNR denied the request for a hearing; however on remand from Milwaukee County Circuit Judge Carl Ashley, the hearing was granted on June 29, 2020. On July 14, 2020, the DNR requested that the Division of Hearings and Appeals conduct a contested case hearing based on the Petitioners' request for hearing.

A prehearing conference was held on September 11, 2020.

The State of Wisconsin Division of Hearings and Appeals will hold a contested case hearing in the above captioned cases from December 1 until December 3, 2020. It is expected that testimony will be heard at the hearing.

PLEASE NOTE: In light of the state of public health, the location of this hearing is subject to change, in that it may not be safe to convene in person, in which case the hearing will be conducted via videoconference. On April 19, 2019, the DNR issued a permit to Linda Wright to install riprap on the banks of the Milwaukee River in the Village of River Hills, Milwaukee County, pursuant to Wis. Stat. 30.12(3m), specifically on her property described as being in the NW1/4 of the NE1/4 of Section 18, Township 08 North, Range 22 East.

On May 16, 2019, Frederick and Anne Vogel submitted a petition for a contested case hearing to review the decision and, on June 17, 2019, the DNR denied the request for a hearing; however on remand from Milwaukee County Circuit Judge Carl Ashley, the hearing was granted on June 29, 2020. On July 14, 2020, the DNR requested that the Division of Hearings and Appeals conduct a contested case hearing based on the Petitioners' request for hearing.

A prehearing conference was held on September 11, 2020.

The State of Wisconsin Division of Hearings and Appeals will hold a contested case hearing in the above captioned cases from December 1 until December 3, 2020. It is expected that testimony will be heard at the hearing.

PLEASE NOTE: In light of the state of public health, the location of this hearing is subject to change, in that it may not be safe to convene in person, in which case the hearing will be conducted via videoconference. Members of the public interested in observing this hearing or providing comment at the conclusion of the presentation of evidence should monitor the DNR website for updated information about whether the hearing will convene in person or via videoconference.
