Waterway & Wetland Permits: Municipalities

Municipalities are in a unique situation as they can play a pivotal role in educating their residents and contractors that work within the municipal limits on the importance of sediment and nutrient runoff on local streams and lakes. They can even provide recommendations on how to reduce pollution to ensure that the quality of their waters continues to be unimpaired.

Questions

Question 1: We have received funding to build new roads through the Department of Transportation, and these roads will cross streams. Is there anything special that we need to do?

Answer: Municipal transportation projects are funded through the DOT.

Question 2: As a municipality aren’t we exempt from the permit requirements of the state affecting navigable waterways?

Answer: In most cases municipalities DO NOT enjoy any special status which allows them to do work in and near navigable waterways without a permit. The easiest way to find out if your proposed project requires a permit from the state is to visit our Activity Index and look up the type or project you are interested in undertaking.
