Petroleum Environmental Cleanup Fund Award (PECFA)

Reimbursement for PECFA-eligible work is delayed. An increase in the number of PECFA claims submitted has resulted in a budget shortfall for this biennium. Claims will continue to be audited, and will be scheduled for payment when funds become available.

If you have submitted a claim, you will receive a notice within 30 days letting you know the status of your claim.

The PECFA program is currently allocated $9.1M in funds for the 2015-17 biennium (the July 1, 2015, to June 30, 2017, time period) or $4.55M a year. In the Governor's executive budget released on February 8, 2017, he proposed increasing the PECFA funds available for claims to $7.45M in fiscal year 2018 (starting July 1, 2017) and up to $5.4M in fiscal year 2019 (starting July 1, 2018). This is a proposed increase of $3.75M in funds for the upcoming biennium.

The PECFA program provides reimbursement of eligible expenses for the investigation and cleanup of petroleum contamination from product storage systems. Petroleum products include gasoline, gasoline/alcohol blends, kerosene, fuel oil, diesel fuel and used motor oil. Storage systems include underground and aboveground tanks, and associated piping and dispensers.

Overview of PECFA

The PECFA program was created in response to enactment of federal regulations requiring release prevention from underground storage tanks and cleanup of existing contamination from those tanks. Reimbursement cannot be provided for costs incurred before August 1, 1987, or for removal of tanks after November 1, 1991.

As of July 20, 2015, no new sites will be accepted into the program. Check out the PECFA Update [PDF] to learn more about the program changes and sunset date.


Eligible entities include local governments and private parties responsible for discharges from:

  • registered commercial underground and aboveground tanks of 110 gallons or more;
  • certain farm and residential vehicle fuel tanks;
  • certain home heating oil systems;
  • public school district and technical college district heating oil tanks; and
  • certain tanks located on tribal trust land.
Activities funded
  • Site investigation and remedial action planning.
  • Environmental cleanup.
  • Purchase or rental of temporary buildings to house remedial equipment.
  • Restoration or replacement of private or public water supplies.
  • Compensation for third party damages.


Reimbursement resources

Reimbursement is only provided for costs incurred after August 1, 1987 or for tank removals before November 1, 1991.

All PECFA claims must be submitted to the DNR by June 30, 2020.  No claims will be accepted after this date.  In addition, claims for PECFA reimbursement must be submitted to DNR within 180 days after incurring the eligible costs, or by Feb. 1, 2016, whichever is later.

Usual and Customary (U&C) Cost Information

The Usual and Customary Cost Schedule (Cost Schedule) is a reimbursement schedule that reflects the maximum amount that PECFA will reimburse for tasks listed on the Cost Schedule at the time the task activity is conducted. It is not intended to set the price for specific tasks. The DNR can consider variances to the Cost Schedule on a case-by-case basis. For more information, see s.292.63(4)(cm), Wis. Stats. [exit DNR]

Consultant information

If a responsible party intends to seek reimbursement under the PECFA program, the consulting firm or contractor that performs services must be a registered PECFA consulting firm (RR-993) [PDF] or a registered PECFA consultant (RR-994) [PDF] per ch. SPS 305, Wis. Adm. Code.

How to become a PECFA agent

PECFA consultant-agent status is an alternative approach to funding cleanup activities at PECFA-eligible sites. It is designed to be an additional tool to help sites that have become stalled move forward. For more information contact the PECFA project manager in your region.


Contract notification and site reporting

Progress reports must be completed to inform DNR of progress and estimated costs at various times during both investigation and remediation, per ch. NR 747.62, Wis. Adm. Code [exit DNR]. The links provided will direct you to the reporting application where you can enter and submit all required information directly on-line, or will provide you with information to assist you with the reporting process.

Note: Chapter SPS 305.10(1)(a)13.c., Wis. Adm. Code [PDF exit DNR], provides the ability for PECFA to deny, suspend or revoke the PECFA registration for any consultant who has "failed to submit a required notice or report to DNR, within the required time period."

Contaminated Lands Environmental Action Network (CLEAN)

An inter-linked system providing information on different contaminated land activities in Wisconsin. It has two components: BRRTS on the Web and RR Sites Map.

This database is the DNR Remediation & Redevelopment Program's main tool to assist customers with the investigation, cleanup and eventual re-use of contaminated lands.

Tank Registry [exit DNR]
(aka Storage Tank Database)

This database includes both underground and aboveground tanks that are required to be registered. The database reflects only those tanks that have been registered.

If your search does not produce a tank, this does not guarantee that a tank does not exist on the property. Some tanks, such as heating fuel tanks in the basement of homes are not required to be registered. Some tanks, while required to be registered, have not been registered and therefore will not appear on the database.

Frequently asked questions

Why is the PECFA program moving from DSPS to DNR?

The transfer is part of the state's 2013-2015 state budget. With it, the state will see just over $1 million in program savings during the two-year budget cycle. The transfer consolidates similar petroleum cleanup programs under one roof and eliminates duplication of services. Better customer service is provided because all PECFA-related issues can be addressed in a unified, consistent manner.

When does the transfer take effect?

Officially, the transfer took place on July 2, 2013, the effective date of the state budget. Staff from DSPS will move into their new DNR offices in mid- to late July.

Will DNR acquire all the petroleum tank-related programs from DSPS?

No. Only the financial and technical oversight portions of the PECFA program are moving to DNR. The responsibility for administering Wisconsin's storage tank regulations – including the tank registry database – is moving to the Dept. of Agriculture, Trade and Consumer Protection.

Are there any new fees associated with the program now that it's at DNR?

Yes. Like the high priority sites that have been the jurisdiction of the DNR, the transferred DSPS sites that are considered low- and medium-risk sites will now be subject to the case closure fees in ch. NR 749, Wis. Adm. Code. This will apply to any case closure submittal received by the DNR on or after July 2, 2013.

What forms, guidance and publications should consultants and responsible parties (RPs) use in the future?

After July 2, 2013, RPs and consultants should be using DNR forms, publications and guidance, which can be accessed on the RR program's web pages. If you have questions, please contact Jenna Soyer.

Which case closure form should be used?

For any case closure request submitted to the DNR after July 2, 2013, it should be submitted on the DNR's Case Closure Request (Form 4400-202) [PDF]. However, in recognition of this transfer period, DNR will accept the old DSPS closure form for any low- or medium-priority sites up until August 2, 2013. Any new case closure request postmarked after August 2, 2013, will need to be submitted using DNR Form 4400-202.

How can I reach the former DSPS staff?

The PECFA claims review staff and hydrogeologists working in Madison will soon be located in the DNR's central office in Madison. The remaining DSPS staff will be located generally in the same areas of the state as they currently serve.

Telephone numbers for those staff will be available soon. That information will be added to the website when it becomes available.

Why does the DNR still refer to DSPS administrative codes and ch. 101, Wis. Stats?

Following adoption of the 2013-2015 budget, the Legislative Reference Bureau will initiate the process to make necessary changes to the Wisconsin Administrative Code. This process will take time to complete and, during such time the regulations currently identified as "DSPS" will remain effective.

At the end of the legislative session, the Legislative Reference Bureau updates and prints the Wisconsin Statutes. Following adoption of the budget, online references to the statutes will be updated to reflect the changes. Official publication of the updated statutes will take longer. The statutory authority transferred to DNR will become part of the ch. 292, Wis. Stats., Remedial Action, and is effective upon adoption of the 2013-2015 budget.

How will I access the DSPS electronic databases?

The DNR is in the process of moving the DSPS PECFA-relevant databases (Tracker, Consultant Registry) over to DNR. Until the transfer occurs, continue to access the DSPS databases.

Will a new electronic newsletter replace the PECFA Update?

Yes. Program information will be routinely shared through the RR Report.
