Recently enacted 2011 Wisconsin Act 32 transferred the regulation of erosion control at commercial building sites from the Department of Natural Resources (DNR) to the newly-created Department of Safety and Professional Services (DSPS). This legislation also requires the DNR and the DSPS to enter into a Memorandum of Understanding (MOU) delineating each agency's responsibilities in administering erosion control activities and the approach in which the DSPS will regulate erosion control activities at commercial building sites of one acre or larger in a manner consistent with the DNR.
The two agencies are currently working together to make the transfer of responsibilities successful and will be providing more information on the transfer as the process continues and the MOU is developed. In the meantime, landowners with construction projects requiring coverage under the construction site storm water discharge permit should continue to apply to the DNR at this time.
