Incidental Take Public Notice:Proposed Stu's Flooring DevelopmentProposed Incidental Take Authorization for the proposed Stu's Flooring Development, City of Greenfield, Milwaukee County, Wisconsin. The Department of Natural Resources proposes to authorize the "incidental taking" of the state-threatened Butler's gartersnake (Thamnophis butleri) resulting from the Stu's Flooring Store development proposed by Loomis Development LLC. The 4.6 acre parcel is located on the northerly side of W. Loomis Rd. (STH "36"), located between W. Edgerton Avenue and Loomis Road in the City of Greenfield, Milwaukee County. Loomis Development LLC plans to develop a commercial building with associated access driveway, onsite asphalt parking and underground utilities on approximately 1.8 acres of the 4.6 acre parcel. Honey Creek, a navigable waterway, and associated wetlands are located within the northern portion of the site and will not be impacted by the project. The presence of the state-threatened Butler's gartersnake was confirmed at the site and the snake habitat includes the open canopy wetlands and associated open canopy uplands. The upland portion of this habitat is proposed for development (approximately .6 acre) with a portion to be restored to appropriate vegetation. Through the Incidental Take Consultation process, Loomis Development LLC modified project plans to avoid and minimize potential take of the snake and agreed to restore habitat for the snake. The Department has determined that the proposed project will minimize the impacts to the snake by adhering to the conservation measures; is not likely to jeopardize the continued existence and recovery of the state population of these snakes or the whole plant-animal community of which they are a part; and has benefit to the public health, safety or welfare that justifies the action. The authorization was finalized on October 15, 2003.
