General Hazardous Waste Annual Reporting Information

Information specific to hazardous waste annual reporting includes:

Authority

The authority for the Hazardous Waste Annual Report is contained in chs. NR 660-679 [exit DNR], Wis. Adm. Code. Those chapters require small and large quantity hazardous waste generators, certain hazardous waste treatment, storage and disposal facilities and permanent household and very small quantity generator hazardous waste collection facilities that ship hazardous waste off-site to a licensed or permitted hazardous waste treatment, storage or disposal facility to report to the DNR every year on their regulated waste activities. Chs. NR 600-679 also authorize the DNR to obtain additional data to support development or enforcement of Wisconsin's hazardous waste regulations.

Deadline

Chs. NR 662 and 664-666, Wis. Adm. Code, require the Hazardous Waste Annual Report to be submitted to DNR by March 1 of each year (for the previous reporting year).

Reporting Requirements

All sites are required to prepare and submit an annual report if during the report year the site did any of the following:

  • Generated in any calendar month:
    • more than 100 kilograms (220 pounds) of hazardous waste;
    • more than 1 kilogram (2.2 pounds) of acute hazardous waste; OR
    • more than 100 kilograms (220 pounds) of acute hazardous waste spill cleanup material.
  • Accumulated at any time:
    • more than 1,000 kilograms (2,205 pounds) of hazardous waste; OR
    • more than 1 kilogram (2.2 pounds) of acute hazardous waste; OR
    • more than 100 kilograms (220 pounds) of acute hazardous waste spill cleanup material that was generated on-site.
  • Was a publicly owned (wastewater) treatment works (POTW) that accepted hazardous waste (via truck, rail or dedicated pipe) for treatment and complied with s. NR 670.001(3)(b)9.
  • Was a permanent household and very small quantity generator hazardous waste collection facility that ships hazardous waste off-site to a licensed or permitted hazardous waste treatment, storage or disposal facility.
  • Performed any other hazardous waste treatment, storage or disposal activities on-site that required a hazardous waste facility license.
  • Treatment, storage and disposal activities that do not require a hazardous waste license include the following:

    • Generator storage or treatment of hazardous materials in on-site containers or tanks in compliance with the applicable generator accumulation requirements in ss. NR 662.034, 662.192 or 662.220.
    • Operating totally enclosed treatment facilities, elementary neutralization units and wastewater treatment units as defined in s. NR 660.10.
    • Licensed transporter storage of manifested shipments of hazardous waste in containers meeting s. NR 662.030 requirements at a transfer facility for no more than 10 days.
    • Management of universal wastes by universal waste handlers and transporters that comply with the applicable requirements in s. NR 673 or guidance in the DNR's universal waste publications.

Reporting Exemption

If your site did not meet the above reporting requirements during the report year, you will be directed to complete and submit the Exemption Form through the Web Reporting system. The Exemption Form must be printed and signed by the waste report certifier at your site (whose name will be pre-printed on the document). Then send it to the DNR at the address that is printed at the top of the form or to:

The DNR regional staff will evaluate your exemption request and, if appropriate, will remove your site from the list of those required to complete annual hazardous waste reports for future years.

Hazardous Waste Forms Which Must Be Completed for 2011

Identification (IC) Form

All sites are required to provide the minimal site activity information collected on the Web reporting system reporting requirements screen for both the report year and the current year. The IC Form, which collects additional identifying information, is required for sites that were in any of these activity categories during the report year:

  • Large Quantity Generator (LQG)
  • Small Quantity Generator (SQG)
  • Treatment, Storage or Disposal (TSD) Facility
  • Publicly owned (wastewater) treatment works (POTW) that accepted hazardous waste (via truck, rail or dedicated pipe) for treatment and complied with s. NR 670.001(3)(b)9.
  • Permanent Household and Very Small Quantity Generator Hazardous Waste Collection Facility that ships hazardous waste 0ff-site to a licensed or permitted hazardous waste treatment, storage or disposal facility.

Fee Worksheet (FW) Form

The FW Form of the Hazardous Waste Annual Report is required for sites that were a small quantity generator, a large quantity generator, a treatment, storage or disposal facility or a permanent household and very small quantity generator hazardous waste collection facility that ships hazardous waste off-site to a licensed or permitted hazardous waste treatment, storage or disposal facility.

Waste Generation and Management (GM)Form

The GM Form of the Hazardous Waste Annual Report is required for odd-numbered report years (i.e., 2009, 2011, etc.) for sites that were a large quantity generator or a treatment, storage or disposal facility during the report year. A separate set of GM Form information must be completed for each type of hazardous waste generated, accumulated, managed on-site, shipped off-site or imported from a foreign country during the report year.

Waste Received from Off-site (WR) Form

The WR Form of the Hazardous Waste Annual Report is required for odd-numbered report years (i.e., 2009, 2011, etc.) for sites that received hazardous waste from off-site during the report year. Generally, the WR Form is completed by licensed treatment, storage or disposal (TSD) facilities, or by publicly owned wastewater treatment works (POTWs) that accept hazardous waste. A separate set of WR Form information must be completed for each type of hazardous waste received from an off-site source during the report year and managed on-site.

Certifying Hazardous Waste Report Information

After submitting your data through the Web reporting system, the one page Certification Form (or the Exemption Form if completed instead) must be printed and signed by the waste report certifier at your site (whose name will be pre-printed on the document). Send only this page of the report to the DNR at the address that is printed at the top of the form or to:

Data Usage

The DNR shares Hazardous Waste Annual Report data for odd-numbered reporting years with the U.S. Environmental Protection Agency (EPA). The EPA uses the data for planning and developing regulations, compliance monitoring and enforcement. Also, the data allow the EPA to determine whether its regulations are having the desired effect on the generation and management of hazardous waste. For example, the data provide information on whether waste management has shifted from one method of disposal to another. Some of the DNR uses of Hazardous Waste Annual Report data include support of planning, fee assessment, compliance monitoring and enforcement.
