General Hazardous Waste Annual Reporting Information

Information specific to hazardous waste annual reporting includes:

Authority

The authority for the Hazardous Waste Annual Report is contained in chs. NR 660-679 [exit DNR], Wis. Adm. Code. Those chapters require small and large quantity hazardous waste generators and certain hazardous waste treatment, storage and disposal facilities to report to the DNR every year on their regulated waste activities. Chs. NR 600-679 also authorize the DNR to obtain additional data to support development or enforcement of Wisconsin's hazardous waste regulations.

Deadline

Chs. NR 662 and 664-666, Wis. Adm. Code, require the Hazardous Waste Annual Report to be submitted to DNR by March 1 of each year (for the previous reporting year).

Reporting Requirements

All sites are required to prepare and submit an annual report if the site did any of the following:

  • Generated in any calendar month:
    • more than 100 kilograms (220 pounds) of hazardous waste;
    • more than 1 kilogram (2.2 pounds) of acute hazardous waste; OR
    • more than 100 kilograms (220 pounds) of acute hazardous waste spill cleanup material.
  • Accumulated at any time:
    • more than 1,000 kilograms (2,205 pounds) of hazardous waste; OR
    • more than 1 kilogram (2.2 pounds) of acute hazardous waste; OR
    • more than 100 kilograms (220 pounds) of acute hazardous waste spill cleanup material that was generated on-site.
  • Was a publicly owned (wastewater) treatment works (POTW) that accepted hazardous waste (via truck, rail or dedicated pipe) for treatment and complied with s. NR 670.001(3)(b)9.
  • Performed any other hazardous waste treatment, storage or disposal activities on-site that required a hazardous waste facility license.
  • Treatment, storage and disposal activities that do not require a hazardous waste license include the following:

    • Generator storage or treatment of hazardous materials in on-site containers or tanks in compliance with the applicable generator accumulation requirements in ss. NR 662.034, 662.192 or 662.220.
    • Operating totally enclosed treatment facilities, elementary neutralization units and wastewater treatment units as defined in s. NR 660.10.
    • Licensed transporter storage of manifested shipments of hazardous waste in containers meeting s. NR 662.030 requirements at a transfer facility for no more than 10 days.
    • Management of universal wastes by universal waste handlers and transporters that comply with the applicable requirements in s. NR 673 or guidance in the DNR's universal waste publications.

Reporting Exemption

If your site did not meet the above reporting requirements during the report year, you will be directed to complete the Exemption Form and submit it through the Web Reporting program. Then print the Exemption Form, sign it and send it to the address on the form: Hazardous Waste Reporting-WA/5, WI DNR, PO BOX 7921, Madison, WI 53707-7921. The DNR regional staff will evaluate your exemption request and, if appropriate, will remove your site from the list of those required to complete annual hazardous waste reports for future years.

Hazardous Waste Forms Which Must Be Completed for 2008

Identification and Certification Form

A site that meets the above reporting requirements during the report year must complete and submit the Identification and Certification (IC) Form as a component of the Hazardous Waste Annual Report.

Fee Worksheet Form

A site that meets the above reporting requirements and generated any hazardous waste during the report year must also complete and submit the Fee Worksheet (FW) Form.

Certifying Hazardous Waste Report Information

The hazardous waste program requires you to certify the information provided on the Hazardous Waste Annual Report. Print the certification form from your Web browser, sign it, and send only the certification form to:

Data Usage

The DNR shares Hazardous Waste Annual Report data for odd-numbered reporting years with the U.S. Environmental Protection Agency (EPA). The EPA uses the data for planning and developing regulations, compliance monitoring and enforcement. Also, the data allow the EPA to determine whether its regulations are having the desired effect on the generation and management of hazardous waste. For example, the data provide information on whether waste management has shifted from one method of disposal to another. Some of the DNR uses of Hazardous Waste Annual Report data include support of planning, fee assessment, compliance monitoring and enforcement.
