Air toxics permitting

In many instances, sources are allowed to demonstrate they comply with provisions of NR 445 without reopening their operation permits.

If a source has existing provisions that reflect Best Availble Control Technology (BACT) or Lowest Achievable Emission Rate (LAER), as approved by DNR, and the revisions do not change the standard for that hazardous air pollutant (HAP) then those requirements meet the NR 445 rule revisions. If a HAP was considered a carcinogen requiring BACT before the rule revision, but now the carcinogen requires LAER under the rule revision, the company will need to evaluate options contained in the revised NR 445 to comply with the amended NR 445 requirements.
