Air Toxics Due Diligence

Special provisions were added to the amended NR 445 to allow companies to show they comply. Sources may supply air quality modeling to show they do not exceed concentrations established to address health concerns.

The amended rule also contains safe harbor and due diligence provisions. Safe harbor and due diligence means sources that act in good faith are not penalized for discovering unforeseen emissions contained in NR 445 at a later date.
