Wisconsin's air toxics rule (Chapter NR 445, Wis. Adm. Code) took effect on December 1, 2004. The chapter was republished in August 2008 and is available from the Revisor of Statutes Web site [exit DNR].
Air Toxics Rule Revisions Took Effect July 1, 2004
The official version of the NR 445, NR 406, NR 407 and NR 438 revisions are available from the revisor of statutes web page (exit DNR). (Note: the rule revision also makes changes to NR Chapters 400, 410, 419, 422, 423, 439, 446, 447, 448, 449, 468, 484). Revisions to Ch. NR 445 and Related Chapters Sent to Revisor of Statutes for Publication.
The Ch. NR 445 Rule Revision Package (Board Order AM-34-02) has been reviewed by the Senate Committee on Environment and Natural Resources and the Assembly Committee on Natural Resources and signed by DNR Secretary Hassett. The package has now been sent to the Revisor of Statutes for publication. Anticipated effective date for the revisions is July 1, 2004.
Modifications to Ch. NR 445 and Related Chapters Approved by The Natural Resources Board
At its February 24-25, 2004 meeting, the Natural Resources Board approved modifications to the Ch. NR 445 Rule Revision Package (Board Order AM-34-02). The approved order has now been sent back to the Senate Committee on Environment and Natural Resources and the Assembly Committee on Natural Resources for their consideration.
Modifications to Ch. NR 445 Rule Revision Package
Modifications to the Ch. NR 445 Rule Revision Package (Board Order AM-34-02) are proposed to be adopted at the February 24-25, 2004 Natural Resources Board meeting. The modification package is now available and includes:
- The "Green Sheet" and "Background Memo" which give an overview of the proposed modifications to the Natural Resources Board.
- The recommended modifications to the rule revision language.
- List of chemicals no longer proposed to be added to NR 445
- Miscellaneous amendments submitted to the Natural Resources Board on February 24, 2004 (81K PDF)
This February green sheet for AM-34-02 also included as its final attachment the October 3, 2003 letter to Secretary Hassett from Senators Kedzie and Johnsrud which was posted earlier.
Letter to Secretary Hassett from Legislature asks for changes to the April 2003 NR 445 rule package
On October 3, 2003, the Senate Committee on Environment and Natural Resources and the Assembly Committee on Natural Resources sent the following letter to the Department requesting modifications in Clearinghouse Rule 02-097 (NR 445), Control of Hazardous Air Contaminants. The Department is currently reviewing the letter.
Assembly and Senate Environmental Committees return rule package to the DNR
On May 28, 2003, the Assembly Committee on Natural Resources and the Senate Committee on Environment and Natural Resources made requests to the department to consider modifications to the air toxics rule package approved by the Natural Resources Board in April. The department has agreed to this request and is expected to continue discussions with the Committees in the near future. NRB adopts air toxic rule revisions
The air toxics rule package (as amended and corrected as detailed in the errata document) was adopted by the Natural Resources Board on April 22, 2003. The rule package now goes to the State Legislature for their review.

Air toxics rule revision package now available
Revisions to Wisconsin's Air Toxics Rule, Ch. NR 445 (AM-34-02) are proposed to be adopted at the April 22-23, 2003 Natural Resources Board Meeting in Madison, Wisconsin. The rule package includes rule language, a background document, responses to comments and other attached materials.
