Indirect Source Permitting Exemptions
All indirect sources that are
not exempt require an indirect source construction permit. The exemptions
are divided into two areas: parking areas and roadway projects. There are different requirements for indirect
source permitting, depending on the indirect source county location. All counties not identified as metroplitan counties are designated
non-metropolitan counties. The 24 metropolitan counties include: Brown,
Calumet, Chippewa, Columbia, Dane, Douglas, Eau Claire, Iowa, Kenosha, Kewaunee, La Crosse, Marathon,
Milwaukee, Oconto, Outagamie, Ozaukee, Pierce, Racine, Rock, Sheboygan, St. Croix,
Washington, Waukesha, and Winnebago.
Parking Lots
Metropolitan Counties
A project is exempt from indirect source permitting requirements if it
is located in a metropolitan county and:
- the new parking facility has a parking capacity of less than
1,000 motor vehicles in its associated parking areas or less than 350,000 square feet of impervious surface dedicated to parking and "maneuver" such as at a distribution center; or
- the modified parking facility has a parking capacity increase
of less than a 1,000 motor vehicles in its associated parking areas.
Non-Metropolitan Counties
A project is exempt from indirect source permitting requirements in a non-metropolitan county when:
- the new parking facility has a parking capacity of less than
1,500 motor vehicles in its associated parking areas or less than 525,000 square feet of impervious surface dedicated to parking and "maneuver" such as at a disbritution center; or
- the modified parking facility has a parking capacity increase
of less than a 1,500 motor vehicles in its associated parking areas.
Roadway Projects
Metropolitan Counties
A project is exempt from indirect source permitting requirements if it
is located in a metropolitan county and:
- any new road or highway segment or new intersection leg which has
a peak hour volume of less than 1,200 motor vehicles per hour.
- any modified road or highway segment which has an increase of less
than 1,200 motor vehicles per hour.
- A maximum shift in the intersection leg is:
- less than 12 feet to the nearest roadway edge toward any potential
receptor location withing the new intersection boundary for any
modified interesection.
- 12 or more feet and each new road or highway segment has no more
than 2 approach lanes, not includeing exclusive turning lanes, and
any potential receptor is located at more than 25 feet from the nearest
roadway edge and the peak hour volume on each approach is less than 1,800 motor vehicles per hour.
Non-Metropolitan Counties
A project is exempt from indirect source permitting requirements if it
is located in a non-metropolitan county and:
- new road or highway segment will carry less than four lanes of traffic
- any new intersection in which each leg will carry less than four lanes
of traffic
- any modified road or highway segment or modified intersection which
will have less than less than 2 additional lanes of traffic.
- any new road or highway segment or new intersection leg which has
a peak hour volume of less than 1,800 vehicles per hour.
- any modified road or highway segment that has an increase in peak
hour volume of less than 1,800 motor vehicles per hour.
